Trump demands court ignore DOJ request for gag order

Trump’s lawyers claim gag order would violate free speech

Former President Donald Trump has resisted a Justice Department request for a gag order related to his prosecution.

Trump’s legal team released a 25-page brief opposing the DOJ’s request, emphasizing the importance of free speech and the need for transparency.

“The prosecution silences President Trump, especially when the right to criticize the government is critical during a political campaign, to prevent public criticism of the prosecution. However, “Above all else, the First Amendment means that the government cannot suppress expression. Its message, ideas, subject matter, or content,”” the brief said. As stated.

“The prosecution may not appreciate President Trump’s perfectly legitimate criticisms, but neither the prosecution nor this court should act as a gatekeeper to what the public can or cannot hear,” the document further emphasized.

The brief was filed Monday and challenges prosecutors’ claims that Trump’s history of inflammatory comments about political opponents threatens legal action.

Special counsel Jack Smith’s team is seeking to limit the former president’s ability to comment on the case, arguing that his famously fiery and confrontational rhetoric could influence jurors’ perceptions.
